WDNY Plan for Addressing the Retroactive Application of 2023 U.S.S.G. Criminal History Amendments

On August 24, 2023, the United States Sentencing Commission voted to give retroactive effect in certain cases to Parts A & B, subpart 1 of Amendment 821 (the criminal history amendments).  As Congress has elected not to act to the contrary, the U.S. Courts are authorized as of November 1, 2023, to conduct sentence reduction proceedings and enter orders pursuant to 18 U.S.C. §3582(c)(2) provided that any order reducing a term of imprisonment has an effective date of February 1, 2024, or later.

In preparation for this event, the U.S. District Court for the Western District of New York has released its plan for addressing the retroactive application of the criminal history amendments.  Click here to see the Plan.
