            United States Magistrate Judge Hugh B. Scott seeks another term as a recalled Magistrate Judge in the Western District of New York.  Judge Scott’s current term expires on July 1, 2017.  The Judicial Council of the Second Circuit is considering the reappointment of Judge Scott to another one-year term of office and has determined that he appears to merit reappointment subject to public notice and opportunity for public comment.

 

            Upon reappointment, the incumbent would continue to perform the duties of a magistrate judge as specified in title 28, United States Code 636(h).

USDC-WDNY Judge Sharing Program - Implementation date January 2017

The District Court of the Western District of New York has entered into a Judge Sharing program with the District of Vermont. Pursuant to a Memorandum of Understanding, three judges in the District of Vermont will be randomly assigned new civil cases from our civil assignment wheel. They will be responsible for the cases from filing to disposition, trial, appeal or remand. Most of the proceedings will be conducted by video conferencing. If a hearing or trial is necessary, the Vermont Judge will travel to the Western District of New York to handle the matter. This is a three year national pilot program with the goal of assisting District Courts with large caseloads. The local rules of the Western District of New York will be applied to the cases handled by the Judges of the District of Vermont.

New Federal Rules of Civil Procedure Effective December 1, 2015

 

Amendments to the Federal Rules of Civil Procedure adopted by the Supreme Court in April 2015 and accepted by Congress took effect on December 1. The changes affect Civil Rules 1, 4, 16, 26, 30, 31, 33, 34, 37, 55, and 84, and the Appendix of Forms. The amendments will govern all proceedings commenced on or after December 1, 2015, and all proceedings then pending “insofar as just and practicable.”

 

The application of the new rules to already-filed cases is authorized by 28 USC §2074(a), which provides in pertinent part:  
The Supreme Court may fix the extent such rule shall apply to proceedings then pending, except that the Supreme Court shall not require the application of such rule to further proceedings then pending to the extent that, in the opinion of the court in which such proceedings are pending, the application of such rule in such proceedings would not be feasible or would work injustice, in which event the former rule applies.

PSAP Temporary Closing

The Pro Se Assistance Program will close temporarily from August 24 through September 4, 2015, and will re-open on Wednesday September 9, 2015.  As in the past, it will be open for assistance on Wednesdays and Fridays from 11:30am to 2:00p.

Attorney Account Update

The U.S. District Court for the Western District of New York is updating it's records of attorney information.  This action is being performed to update and improve the accuracy of our attorney information.  This update also includes requests for information that will help the court enhance its pro bono program.

The court is asking all attorneys to complete the survey request accessible via the link below.  All attorneys must complete the survey no later than the close of business on May 15, 2015.  Attorneys who fail to complete the survey by that time will have their ECF account disabled until such time the survey is completed.  Should you have any questions, please contact the Office of the Clerk (716-551-1700).

CM/ECF Training

The United States District Court for the Western District of New York will offer CM/ECF training to attorneys and their staff.  Sessions will run 60-90 minutes with demonstration, hands-on training, and Q&A discussion.  Topics include case opening procedures, filing various documents, and maintaining accounts.

Notice of Increase to Pro Hac Vice Fee

Effective October 1, 2012, the United States District Court for the Western District of New York is increasing the pro hac vice attorney admission fee to $150.00 in order to supplement the fund used to pay pro bono counsel expenses.

Change to District Court Fee Schedule

June 1, 2012

The Judicial Conference approved a minor change to the miscellaneous fee schedule for the District Courts.  Effective June 1, 2012, the Document Exemplification Fee will increase to $21.00.
